Membership discount cards

These Terms and Conditions set out the basis on which you can use your Renew Physio Membership Card. Please read them carefully as they contain important information and keep a copy of them for your reference.

Interpretation

In these Terms and Conditions the following words and expressions shall have the meanings set out next to them:

"Renew Physio Membership Card" means the card available from us that, subject to these Terms and Conditions, entitles the lawful holder to participate in the Renew Physio Membership Scheme;

"Renew Physio Membership Card Scheme" means the scheme operated by us that entitles certain individuals to certain discounts against certain products and/ or services offered, supplied and performed by us;

"Terms and Conditions" means these Renew Physio Membership Discount Card Terms and Conditions;

"us" or "we" or "our" means Renew Physiotherapy Limited, a company incorporated in Scotland (Company No. SC.338946) with its registered office at 16 Canning Street, Edinburgh, EH3 8EG;

"Website" means the website located at www.renewphysio.com; and

"you" or "your" means an individual who has acquired from us with our authority, or an individual that someone else has acquired from us, with our authority, on their behalf, a Renew Physio Membership Card and is, accordingly, the lawful holder of the Renew Physio Membership Card.

1. General

1.1 These Terms and Conditions apply to your use of the Renew Physio Membership Card and they also govern the relationship between us and you in relation to your said use of the Renew Physio Membership Card and your entitlements and benefits as the lawful holder of such Renew Physio Membership Card.

1.2 We are the promoter of all Renew Physio Membership Cards.

1.3 Certain products and services offered by us may, at our discretion, be excluded from the Renew Physio Membership Card Scheme and the details of such excluded products and services are available from us on request and shall be indicated as such on our Website.

1.4 By using your Renew Physio Membership Card you indicate that you accept these Terms and Conditions and that you agree to be bound by them at all times in your participation in the Renew Physio Membership Card Scheme and the purchase and use by you, under the Renew Physio Membership Card Scheme, of products sold and services supplied by us. If you do not agree to be bound by these Terms and Conditions, you may not use your Renew Physio Membership Card or participate in the Renew Physio Membership Card Scheme. 1.5 We reserve the right to change these Terms and Conditions from time to time. Any such changes will take effect when posted on the Website and your continued use of a Renew Physio Membership Card shall constitute your acceptance to be bound by the latest Terms and Conditions.

2. Renew Physio Membership Cards

2.1 Renew Physio Membership Cards can be purchased at any of our clinics.

2.2 When you purchase your Renew Physio Membership Card, you will receive a ten percent (10%) discount on the total value of the transaction you make on that occasion (excluding the purchase cost of the Renew Physio Membership Card).

2.3 A Renew Physio Membership Card is only valid once it is registered with us and in order to register a Renew Physio Membership Card, you must provide to us your name, address and e-mail details.

2.4 If you subsequently need to change any of the details you used to register your Renew Physio Membership Card with us, please do so via email, info@renewphysio.com. It is your responsibility to notify us of any changes to your details.

2.5 After purchasing a Renew Physio Membership Card we will provide you with a welcome pack with further details of the Renew Physio Membership Card Scheme. In purchasing the Renew Physio Membership Card, you agree to be contacted by us by e-mail, on a regular basis of approximately once a month, to receive Renew Physio's exclusive cardholder promotions, offers and events applicable to the Renew Physio Membership Card Scheme.

2.6 A Renew Physio Membership Card can only be registered in the name of an individual who is resident in the UK and is over the age of 18 at the time of registration.

2.7 Only one Renew Physio Membership Card can be registered per individual.

2.8 A Renew Physio Membership Card is valid for 12 months from the time of its registration. We will notify you when your Renew Physio Membership Card is due to expire.

2.9 Once validated by you, in accordance with clause 2.3 above, a Renew Physio Membership Card:

(a) is (subject to your statutory rights) non-refundable, non-transferable and can only be used by you with your signature on the card;

(b) cannot be used as a credit card, debit card or a cheque guarantee card;

(c) is only for personal and consumer use and can only be used at our participating clinics; and

(d) cannot be used for any transaction where the beneficiary is a business or for the enjoyment or benefit of more than one individual.

2.10 Renew Physio Membership Card cannot be used, and is not effective, in conjunction with staff discount, affiliate or organisational discounts.

3. Loss, Theft or Damage

3.1 You should immediately report any loss, theft, fraudulent or unauthorised use of your Renew Physio Membership Card by contacting the Clinic Manager in accordance with clause 1.4 above.

3.2 In the event of loss, theft, fraud or other unauthorised use of your Renew Physio Membership Card, or if your Renew Physio Membership Card is damaged or malfunctions, we may, at our sole discretion, issue you with a replacement Renew Physio Membership Card which shall be subject to these Terms and Conditions and shall only be valid for the remainder of the unexpired period of the lost, damaged or malfunctioning Renew Physio Membership Card and when we do so issue you with such a replacement Renew Physio Membership Card you shall be required to attend one of our clinics in order to receive such replacement.

3.3 We reserve the right to charge you a fee of up to GBP £2.00 for each replacement Renew Physio Membership Card issued to you.

3.4 If you subsequently find or retrieve a Renew Physio Membership Card which you had previously reported lost or stolen, you must notify the relevant clinic manager immediately in accordance with clause 1.4 above.

4. Complaints procedure

4.1 We aim to deal with all complaints as effectively as possible. Our complaints handling procedure is designed to be fair, confidential, easy to use, speedy and informative. In the unlikely event that you wish to make a complaint regarding any element of the Renew Physio Membership Card Scheme, please contact us either:

(a) by e-mail at info@renewphysio.com;

(b) by phone, please call 0131 228 8538; or

(c) by post, please write to us with your complaint to:

Renew Physiotherapy Limited, 16 Canning Street, Edinburgh, EH3 8EG.

5. Refund policy

5.1 In the unlikely event that you are not satisfied with any part of our services, we ask that you notify us, in accordance with clause 4 above, of the basis of your dissatisfaction and/ or the reasons you believe that we have not performed our services in accordance with our terms and conditions. We shall investigate the issues you raise and, if you should seek a refund of the sums paid to us for the affected services, we shall consider your claim for such refund on its own merits and, without prejudice to your statutory rights. If we have not provided our services in accordance with our said terms and conditions, you shall be entitled to:

(a) a full refund of the sums paid to us for the affected Services, if the entirety of our performance of the Services was not in accordance with our said terms and conditions; or

(b) a partial refund of the sums paid to us for the affected Services, if only a part of our performance of the Services was not in accordance with our said terms and conditions (the extent of such partial refund will reflect the extent of the Services not performed in accordance with our said terms and conditions).

5.2 The method of making any refund due to you as a consequence of this refunds policy shall be at our discretion.

5.3 Without prejudice to your statutory rights, our liability to you for losses you suffer as a result of us breaching our said terms and conditions is strictly limited to a refund of the sums paid by you to us for the affected services provided that this does not include or limit in any way our liability: (a) for death or personal injury caused by our negligence; (b) under section 2(3) of the Consumer Protection Act 1987; (c) for fraud or fraudulent misrepresentation; or (d) for any matter for which it would be illegal or unlawful for us to exclude, or attempt to exclude, our liability.

5.4 We shall not, in any circumstances, be liable to you for: (a) loss of income or revenue; (b) loss of business; (c) loss of profits or contracts; (d) loss of anticipated savings; or (e) loss of or corruption to data (nothing in this paragraph shall prevent claims for loss of, or damage to, your tangible property that fall within the foregoing exclusions or any other claims for direct financial loss that are not explicitly excluded.

6. Variation and Cancellation

6.1 If at any time you wish to cancel your Renew Physio Membership Card you may do so by returning your Renew Physio Membership Card to your local clinic in accordance with clause 5 above. If you cancel your Renew Physio Membership Card you will not receive a refund.

6.2 We reserve the right, at any time and without notice, to:

(a) amend or waive any provision of these Terms and Conditions from time to time; and/or

(b) terminate the Renew Physio Membership Card Scheme and in the event that we so terminate we shall refund to you any fees paid by you to us that relate to the unexpired term of your Renew Physio Membership card as of the effective date of such termination; and/or

(c) decline to issue Renew Physio Membership Cards; and/or

(d) on reasonable grounds, withdraw or cancel Renew Physio Membership Cards, where reasonable grounds shall include (but not be limited to):

(i) any abuse or attempted abuse of the Renew Physio Membership Card Scheme; and/or

(ii) any use or attempted use of a Renew Physio Membership Card in a manner which is contrary to these Terms and Conditions; and/or

(iii) any reasonable suspicion of dishonesty we may have on your part in connection with the Renew Physio Membership Card Scheme; and/ or

(iv) any unacceptable behaviour by you at any of our premises.

7. Privacy Policy

7.1 We respect the privacy of all individuals who use our services, including the Renew Physio Membership Card Scheme and our privacy policy located at www.renewphysio.com explains what information we gather from you, how we use it and how you may control our use of your personal information. Please read the following carefully to understand our views and practices regarding your personal data and how we will treat it.

7.2 For the purposes of the Data Protection Act 1998 (the "Act"), the data controller is Renew Physiotherapy Limited of 16 Canning Street, Edinburgh, EH3 8EG, registered in Scotland with company number SC338946.

7.3 Your application to join and participation in our Renew Membership Card Scheme is subject to our said privacy policy and your participation, including your use of your Renew Membership Card, is subject to your ongoing consent to process your personal data in accordance with our privacy policy. You have the right to ask us not to process your personal data for marketing purposes. We will inform you (before collecting your data) if we intend to use your data for marketing purposes or if we intend to disclose your information to any third party for such purposes. You can exercise your right to prevent such processing, or to opt-out of receiving regular communications from us by checking certain boxes on the application forms we use to collect your data or by emailing us at info@renewphysio.com. If you withdraw your consent to use of your personal information we will stop such use as soon as reasonably practicable.
